Terms and Conditions

1. Terms and Definitions

  1. 1.Definition of Used Terms: The Site: Mazad Motor website and application. Member: Any natural or legal person who has registered on the site to bid or sell. Seller (Advertiser): Any natural or legal person who has added their vehicle to the site for the purpose of selling via auction. Browser: Any person browsing the site without registering. Commercial Partners: Any establishment that Mazad Motor contracts with to provide new and improved additional services, such as inspection, payment, and delivery services.
  2. 2.The terms paragraph above is considered an integral part of the agreement provisions.

2. Basic Registration Obligations

  1. 3.Islamic Sharia teachings, laws, and customs must be observed in all entered data, whether in auction details or member details. Any violation of this will lead to the deletion of the auction and may result in the cancellation of membership on the site.
  2. 4.The use of an unreal or inappropriate username, or the use of ambiguous letters or numbers during the registration process, is not permitted.
  3. 5.It is prohibited to insult, abuse, defame, or write anything that contradicts recognized laws against any person or entity; doing so will result in the deletion of the member's account and everything related to it.

3. Contact Information and Responsibility

  1. 6.The member or seller acknowledges that their contact information (phone number or email) added to the site will be used across the site to enable the other party to communicate and complete the commercial transaction. Therefore, the site is not obligated to maintain the confidentiality of this data required to complete the sale. The member and seller bear full responsibility for everything related to them and filled out on the site; if it turns out this information is incorrect, whether intentional or not, it will result in the deletion of the member's account and all related data.

4. Auction Listing Controls

  1. 7.When adding any vehicle for auction, ensure it is placed in the correct location in terms of section and sub-category.
  2. 8.Credibility must be adhered to in all added auction data (member address, vehicle details text, city, contact numbers, etc.).
  3. 9.Repeating the same vehicle in more than one auction at the same time is not permitted; doing so will result in the deletion of all duplicated auctions, and repeated violations will lead to loss of membership.
  4. 10.You must adhere to vehicle-specific auctions; displaying vague, unclear, or incomplete data is not permitted.
  5. 11.Adding links to other websites for advertising purposes is not permitted.

5. Intellectual Property and Permitted Use

  1. 12.The site is available to visitors and members to enable easy access to car auctions in the Middle East and North Africa. Information provided on the site is for personal use only. Information, including auction details, may not be reproduced or copied to increase traffic to another site for commercial or informational reasons. Additionally, the user may not use the "Mazad Motor" logo or reproduce any content for any purpose without written consent.   2. 13.The content of the site may not be copied, reproduced, published, broadcasted, modified, distributed, or commercially exploited in any way, nor made available through services or networks.

6. Technical Use of the Platform

  1. 14.The use of automated network browsing programs, such as robot spiders, scrapers, etc., to access the Mazad Motor site and collect content for any purpose, or to copy/download content in any other way, is prohibited. A limited exception is granted to search engines and non-commercial public archiving libraries, but not to websites featuring any form of classified listings.
  2. 15.Collecting or harvesting information about others, including their email addresses, without their consent is not permitted.
  3. 16.All auctions, topics, and replies on the site represent their owners and do not represent Mazad Motor or any of its commercial partners.

7. Financial and Commercial Operations

  1. 17.Commercial operations (bidding, selling, buying) between the two parties of the transaction occur through the platform's mechanisms. The site strongly warns against transferring funds outside official channels and approved digital wallets, and advises safe direct dealing.
  2. 18.Agreements or commercial transactions between the two parties (seller and bidder) are based on the bidding system, and the platform acts as the organizer of these operations.
  3. 19.Please note that Mazad Motor is not responsible for financing solutions provided by financing companies and banks if the customer resorts to them to pay the auction value.

8. Dispute Resolution and Indemnification

  1. 20.Nothing here obligates Mazad Motor to intervene as a party in any dispute arising between a member and other members of the site outside the scope of the auction rules.
  2. 21.Under these terms, you agree to indemnify, defend, and hold harmless Mazad Motor, its shareholders, officers, directors, employees, and agents from any claims, lawsuits, demands, damages, losses, or attorney fees alleged or resulting from your use or misuse of the site or any content, your violation of these terms of use, infringement of any third party's property rights, or disputes related to the site arising in any way between the member and one or more other users.

9. Limitation of Platform Liability

  1. 22.Under these terms, Mazad Motor's role is limited, and it disclaims any liability for any damages whatsoever, including without limitation direct, indirect, special, punitive, incidental, and consequential damages and losses affecting any user in relation to the site, the use or inability to use the site, results of its use, or any linked sites and published materials. This includes, but is not limited to, any liability for: loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, or wasted management or office time. Any other loss or damage of any kind however arising, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable. In particular, Mazad Motor assumes no liability for damages or losses affecting the member or a third party as a result of: • Use of the site or inability to use it. • Services or goods obtained through the site. • Any content displayed on the site. • A distributed denial-of-service attack, viruses, or other technologically harmful materials.
  2. 23.You bear the responsibility and risk of using this site. This site is provided to you without any warranties, and Mazad Motor denies providing any warranties or representations of any kind regarding the site or any services provided through it.

10. Credibility and Trademarks

  1. 24.Since vehicle details on Mazad Motor are entered by site users and members, the site is not responsible for any data that lacks credibility despite the inspection. Mazad Motor encourages all users to report any problems, misuse, or other notes regarding the site via email.
  2. 25.The Mazad Motor logo and all member logos on the site are exclusive trademarks.
  3. 26.The member's use of the site, or placing any bid, constitutes their agreement and commitment to all previously mentioned terms of the agreement.

11. Final Provisions

  1. 27.Mazad Motor respects the member's privacy and has therefore developed a detailed privacy policy included in this agreement. We request the member take sufficient time to read our Privacy Policy. Note that by agreeing to these terms, you also agree to our approved Privacy Policy.
  2. 28.All images, prices (opening bid price), and specifications displayed in all sections of the site are for illustrative purposes only to facilitate information gathering for the bidder. The final, binding price is determined by the highest bid upon which the auction closes.
  3. 29.The site reserves the right to change the terms and conditions of this agreement at any time it deems fit. Continued use of the site and its services after modifying these terms and conditions constitutes the member's approval of all terms and conditions.
